I totally sympathise with you, everything does seem like a battle, you don't know where to turn for help and rely on solicitors its very hard but in finding this site i am sure you will get the support you deserve, i'm sure if you have any questions you'll get the answers on this site. Good luck with the appeal, my thoughts are with you.

Welcome Shero-you must be feeling so desperate, the waiting is the worst too. I really hope you get through to appeal ok. How are you coping? are you eating and sleeping ok? I hope you are getting some help from your GP.

Hello, interesting site, I did a google search and your site popped up.

My name is 'Mike' I am currently on bail pending a trial in September for Attempted Murder.

Obviously I am pleading 'Not Guilty' since I did not do it.

I have sought advice and support from all over the place and yet this is the first time I have come across your site.

Over the past year, I have been amazed and horified by our system of policing and justice. As you wrote so aptly, the average person lives in comfortable ignorance of a system that is biased towards treating you as guilty despite the law 'in theory' considering you innocent until proven so.

I was on remand for 5mths until my brilliant solicitors from London put forward a good case for bail and the judge contorted himself into a corner he couldnt back out of. Unfortunately he then sacked my brilliant London solicitors and re-instated my sloppy local solicitors despite the fact that I have a complaint outstanding against them at the Law Society. The croniesm was obvious and startling. I understood that the judge would be impartial, in fact he has been blatantly hostile. Since there is only one judge with the relevant qualifications to hear my case on the local circuit in Hereford/Worcestershire, I already know that this guy is going to hear my case.

I have to admit that despite my generally positive outlook on life and rosy demeanor, I am scared, scared to the core. The prosecution are seeking a life sentence.

Fortunately my friends and father have stood by me, however my wife and her family have abandoned me - not surprising really considering the biased information that the police must be feeding them. This also means that I have not seen my kids for nearly a year as well.

So, that's me, I will check in on this site every now and again. Good luck to everybody, especially to Shero. I hope you have good solicitors who are specialists in this area, if not I am very happy to recommend my london solicitors who are specialists in Rape appeals.

This all seems quite absurd however I have to admit that nothing surprises me anymore, well it does but it doesn't take long to put it in perspective and realise that I shouldn't be. There is much of this I would not dream of commenting on openly in the forum but you're very welcome to discuss your situation in more detail privately if you want by e-mail admin@wronglyaccusedperson.org.uk

The situation with the solicitor is very interesting indeed. In any case unless there is something more to it than I understand from your post, you are perfectly entitled to choose your own solicitor and if you are not happy with your current one, particularly if there is an outstanding complaint lodged against them, then you very much should. Who would ever consider it possible for a solicitor to represent their client fully and impartially if they have lodged a complaint against them at the Law society.

Although I won't comment on my own circumstances, I can confirm that while an accused person faces further charges etc. if any attempt is made to influence a witness, the same attitude is not taken to be the case with the prosecution side. Again, no details but I do have proof that this does go on although it is no longer in my possession but instead with those who should rightly have it. Therefore I know exactly what you mean regarding the influences people are subjected to in the course of seeking conviction. If someone is truly guilty can anyone see a circumstance when this coercion would be needed?

Hi Mark and welcome to the site, i have been reading your posts and find your whole situation shocking, well to be honest i am not shocked. Sadly as i have discovered over the past months this happens all the time, but i have to say I'd not heard of a judge having the right to sack your chosen solicitor, how maddening i do hope that in finding this site you will receive the help and guidance from my bro and Sandra.

Charges are made everyday and it is becoming very clear that the wrong people are being charged/convicted because of bad investigations, accidents turned into things they are not and so forth, good luck with your trial a very difficult time for you and your family you sound very strong and this will help i'm sure.

Thanks for the encouraging words. It seems that you and your family were there and the strength behind Billy's ability to survive in the face of his outrageous circumstances. Although even having read through this site I am still do not fully understand all the ins and outs of it.

Nevertheless it is certainly true that we are defined by the people around us and this enables us to continue.

Hi again gobledegook,

I'm afraid in these situations no one ever can be able to fully understand the circumstances since those with all the information available only provide selected pieces depending on who is asking for it which may/may not be accurate. I'm certain that the fact that I found out further details which would have been very useful to the defence only as a result of acquittal is not unusual, it is simply the case that often the accused becomes wrongly convicted and the related information is therefore unknown. It also highlighted that the information that was made available to the defence was not accurate, and the same can be said for those who base their presumptions on information obtained from the same source which are equally selective/inaccurate, (which incidentally contravenes the FOISA since it undesputably affects a persons chances of a fair trial).

It also leaves you wondering just how much better a verdict could have been in possession of this evidence at time of trial and what other favourable evidence to the defence is withheld. Still it is in the hands of those who can do something about it now.

You are right, the support of family and friends is very much important to an accused persons strength and ability to survive the ordeal along with how well everyone copes afterwards since the results last a lifetime and can't simply be erased by acquittal by whatever means. Case dropped, not proven, not guilty, no difference really the agony continues for everyone.

Its a helpful site and its shocking how many wrongful accusations are made and how badly they are dealt with by the authorities  which struggle to accept that they can make mistakes. Hopefully i shall contribute more when I feel able to do so.

I will get justice and so should all others who know the truth . To the guiilty let it trouble your conscience until your last breath for the harm you cause. The wrongly accused have peace of mind through all that may be put before them.

Hello Reg, and welcome to the site.

I sense from your post that you have been personally affected by a wrongful accusation in some way as have most who come to the site in one form or other unfortunately. For me one of the most important things is not to let the impact of it take over, to make you angry and bitter otherwise so much more of your life is affected. I know only to well it is hard not to be, but by finding wrongly accused person you are helped even by simply taking part in the forum then so much the better.

Some years back i was involved in the family courts processes involving social services and children.

Mistakes were made by social services etc and the judge even said as such at the end of the trial.

Time and again those in authority protected themselves rather than admit errors and take action to correct mistakes, thus not addressing the primary issue of what was in the best interest of the children.  Eventually things got sorted due to hard work.

I am a single parent with a fine son who i love very much.

 Several years back i discovered the Baille website detailing many various court appeals etc which I found interesting as to how decisions  were reasoned and the injustice that had been occurring.

 I am now falsely accused by malicious persons who have targeted us due to their ignorance and own insecurities. This harms both my son, my family and myself. Luckily its not sexual abuse claims or anything like that.  Hopefully i will be able to turn things round and common sense and justice will prevail. I do wonder wether the Police sometimes realise how much time they are wasting  when false accusations are made and how much its disrespecting them too. Teachers being falsely accused is becoming a bigger problem.  Action needs to be taken by those in authorty before things get much worse. Those alleging crimes and the witnesses need to be more thoroughly tested where even small doubts to credibility exist before taking things any further.

It's far better to stop stuff going wrong early on than much later down the line when far more damage has been done to those who do not deserve it.

I think your final sentence sums things up nicely. Prevention is indeed better that cure. To that end I would draw your attention to the child witness petition (the big blue flashy one), there are procedures which if enforced would help prevent some being unnecessarily traumatised.

If you would like to discuss your own issues out with the forum you are more than welcome and can do so either by way of a private message or through the contact link above. If we can be of help or there is somewhere appropriate we can direct you for specific areas we will. Obviously there are reasons why certain details should not be disclosed in the open forum though I do think that the forum itself is an important place in terms of support and encouragement.

In any event, I hope you and your son get what you can fairly and rightly expect.

Hi to everyone, people call me Frank Gallagher cos I live upto the reputation, I question I challenge and I dont accept the illusion that all Laws are right just and serve the porpose there designed for. I know from my own bitter experience. There are many who are themselves victims, convicted by the warped minds of the Judicial itself, it does not always serve justice, it does not always punich criminals, else it would punish those who deliver it uphold it as much as those it attempts to prosecute,

the justice system is an industry as any other, created to fill pockets with gold, renumeration and wealth. If they cared about justice they would think first about the truth, the only truth is the system is not fit for purpose, what its supposed to be there to deliver, it only guarantees loads of money for those who work inside it - and for some those who support it, their clients.
