Nick Rose was found guilty of the murder of Charlotte Pinkney on the 17th Feb 2005. The evidence against him is all circumstantial.

The last sighting of Charlotte Pinkney that we are aware of was on Tues 2nd March, she disappeared from the North Devon town of Ilfracombe, if she is dead her body has never been found.

The North Devon marketing board tells us: In an area of outstanding beauty, nestling snugly amongst the rugged cliffs of the majestic Atlantic Coast lies the town of Ilfracombe. The beautiful & breathtaking scenery of the North Devon coast lies this charming natural harbour.

Ilfracombe also boasts a lively party scene, where drugs were part of nightime entertainment. Charlotte took drugs-alcohol, ecstacy,cannabis & cocaine. She had several boyfriends, the main boyfriend at the time of her disappearance was Gus O'Brien, 41 who was said to have been a drug dealer. Charlotte lived between his flat & her dads home, Gus had recently dumped her belongings etc. at her friend Alexa Williams flat, because they had argued the day before.

There were seven sightings of her after the time that the police said Nick had killed her, and none of these witnesses had been drinking alcohol or taking drugs.When one of the witnesses went to make his statement he was told by the police that he was putting a "Spanner in the works".

Nick has a support group on facebook - Justice for Nick Rose with approaching 2000 members and his case also features on the INNOCENT website.

It's 7 years today since Nick was taken away from his family accused of a murder he didn't commit.
‎7 years is a long time for people to keep things to themselves bottled up knowing there's an innocent person in prison. I would urge them to think about coming forward, and also to think about how many things have happened in that time that Nick has missed out on. You can't get back time, and his innocence won't go away. Every birthday he misses, how many family events he's missing from. It affects everyone, not just Nick, it isn't one life being sacrificed it's many. And what for, so a dangerous person can run around freely? Who is it that is put at risk by people keeping quiet, is it them themselves, or the whole community?

That's quite a burdon, especially if someone else goes missing never to be seen again...

I think there's more than you would imagine nugnug, if I can find the article I saw before I'll post it at the bottom of this but it suggested several per year. For now though her's a link to an article in the Times on it -

Speaking to The Times, a spokesperson for the Crown Prosecution Service (CPS) described such incidents as “rare but not unknown” and “only a very small proportion” of the 648 homicides recorded in 2008/09.
 
Although these cases often require more time than standard murder trials, the advent of modern DNA technology - and without the death penalty at their disposal - English courts are no longer afraid to convict without a body being found.

What this means in Nick's case is, that the persuasive nature of three letters 'DNA' from a microscopic trace the nature of which could be deposited by you, me or anyone else anywhere at any time simply by sneazing - is more important than several eye witnesses seeing the person many days after she has supposedly been murdered. Bare in mind also that the sample DNA might or might not match the missing person's, they didn't have a body to get an actual specimin sample from, so they take samples from family members and hair from a brush that might or might not be hers and come up with a profile they believe could be hers. How many ifs, buts, maybe possiblies are there in there?

But in 2005 a daughter-in-law was coaxed into speaking by her father.

Then Bachan's daughter, who was later declared a hostile witness, told the police about the family meeting where they decided to "get rid" of Surjit, Ms Kharran said.

Surjit's boyfriend also testified in court.

"The daughter gave evidence from behind a screen as she was very frightened and apprehensive as she was giving evidence against her own mother."

Those statements saw Bachan and Sukhdave charged with murder in 2005.

if they dont have a body then theres nothing to match the dna with so that could be anybodys dna.

Exactly, obviously they can narrow it down a little by having a maternal and paternal sample to compare with but at each of the ten points there's likely to be 4 different possible combinations of component pairs so its hardly conclusive. Besides, people sneeze all the time, it doesn't only happen during murders.

and as she was a friend of his she would have been in his car a few times anyway so her dna would be in there.

if you give anybody a lifft there dna is likely to be in your car.

Well, that's another interesting point nugnug. It wasn't actually his car. It was one he, like many people, borrowed. The actual owner loned it to quite a few people in the area, particularly amongst Charlotte's circle of friends so your point that she would have been in the car many times is still valid if not more so because it wouldn't only have been when Nick was borrowing it that she was in it but her other friends too.

and as dna cant be dated exactly well i dont think it can anyway.

theres no proof that the dna that may or maynot be hers was put there when he was using the car.

Well no, not as far as I'm aware. I suppose you can go as far as saying that there is a general acceptance that DNA evidence will diminish over time depending on what type of cells it originates from and the conditions they are in. For example I think it was in the Lynette White case it was discovered that gloss paint was actually very good at preserving DNA from blood underneath it. Whereas the same blood traces left on fence post open to the elements would be lost quite quickly.

I'll get back to you about this more fully later nugnug because it would just be from memory at the moment and I'd rather not say something that though I'm pretty confident about might need to be corrected later.

But for now you can go by them having been together a reasonable time, long enough for her to have moved in with him returning to her parents for a few days here and there if they'd had a spat or whatever, so quite a while. He's no saint, or at least wasn't back then anyway and known to be concerned with the supply of drugs, again at least back then.
